Terms of Service

MotusNEX is a software platform for car haulers, dispatchers, and small fleets to manage revenue, expenses, routes, invoices, fleet documents, maintenance, fuel, customers, and AI-powered business insights. These Terms of Service (the “Terms”) govern your access to and use of MotusNEX. By creating an account or using the platform, you agree to these Terms.
1. What MotusNEX provides
MotusNEX provides business software and reporting tools. It is not a provider of legal, tax, accounting, insurance, or financial advice. Any figures, reports, recommendations, or insights the platform generates are informational only and are not a substitute for professional advice from a qualified advisor.
2. Your responsibilities
You are responsible for how you use MotusNEX and for the accuracy of what you put into it. In particular, you are responsible for:
- Verifying the accuracy of the data, uploaded files, reports, expenses, invoices, and other records you rely on.
- Reviewing AI-generated insights and any recommendations before acting on them. AI insights are informational and should be reviewed by the business owner.
- All business decisions you make, whether or not they were informed by the platform.
- Keeping your login credentials secure and restricting access to authorized users only.
- Having the right and permission to upload any carrier or company documents and records you add to the platform.
3. No guarantee of results
MotusNEX does not guarantee any particular business outcome, including increased revenue or profit. Results depend on many factors outside our control, including your own data, markets, and decisions.
4. Accounts and acceptable use
You must provide accurate account information and keep it current. You agree not to misuse the platform, interfere with its operation, attempt to access accounts or data that are not yours, or use it for any unlawful purpose. You are responsible for all activity that occurs under your account.
5. Subscriptions and billing
Paid plans are billed on a monthly subscription basis through our payment processor, Stripe, and renew automatically unless canceled. Your use of paid features is also governed by our Subscription Terms and Refund Policy.
6. Your content and data
You retain ownership of the business records and files you upload. You grant MotusNEX the permissions needed to store and process that content in order to provide the platform to you. How we handle your information is described in our Privacy Policy.
7. Service availability and changes
We work to keep MotusNEX available and reliable, but the platform is provided on an “as available” basis and may change over time. We may add, modify, or discontinue features, and we may update these Terms. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, MotusNEX is provided “as is” and “as available” without warranties of any kind. MotusNEX and 007 Enterprise LLC are not liable for business losses, lost profits, or decisions made based on information from the platform. Nothing in these Terms limits any liability that cannot be limited under applicable law.
9. Termination
You may stop using MotusNEX and cancel your subscription at any time. We may suspend or terminate access if these Terms are violated or to protect the platform or its users.
